A judge denied the suspect's request Thursday in a /*Johnston County*/ court.
/*Hipolito Hernandez*/ is accused of killing a 7-year-old child while driving drunk.
He's charged with second-degree murder for the death of /*Marcus Lassiter*/.
Hernandez's attorney pleaded with the judge saying, "Your honor, he's being held under a high bond and we're here. We request a hearing at this time."
The judge denied that request and set a new court date for May 22.
Lassiter's family has reportedly vowed to attend every court appearance until Hernandez is sentenced.
Hernandez initially gave authorities a fake name, raising suspicions he might be an /*illegal immigrant*/, but /*Immigration and Customs Enforcement*/ has yet to release his /*immigration*/ status.
