Cynthia Moreland was kidnapped from the Progress Energy parking deck raped and later killed in 2006.
This afternoon Moreland's husband Walter filed a suit in Raleigh superior court saying the city and Progress Energy are negligent.
The suit says Progress Energy should have had patrolling security in the downtown deck during early morning hours and better video surveillance.
Last week Antonio Chance pleaded guilty to Moreland's murder and was sentenced to life in prison.
