Restraining order for Peak Fitness

RALEIGH The order prohibits the health clubs from selling pre-paid memberships until they're bonded and also says clubs cannot cash checks for sales or renewals of pre-paid memberships.

The order stems from a deceptive practices lawsuit filed by North Carolina Attorney General Roy Cooper.

It's not the first time the AG and the fitness club chain have clashed.

In January, Cooper reached an agreement with Peak Fitness over hundreds of complaints about its contracts and business practices.

Under a consent judgment approved by Wake County Superior Court Judge Howard Manning, Peak Fitness and its owners said they would make substantial changes to its customer service system.
