SBI clears officer in shooting

FAYETTEVILLE According to a letter from the SBI that was issued to Fayetteville Police Chief Tom Bergamine, the investigation into the shooting death of Kenmara Davis is closed.

The Cumberland County District Attorney's Office assisted in the investigation and determined that Officer Michael Yount acted in self-defense after Davis fired shots at him.

DA Ed Grannis said Yount responded to the call using correct protocol and "immediately found himself in a self-defense situation that required him to return fire in order to save his own life."

Grannis said a review of all the evidence in the case reveals that "there was no factual basis to bring criminal charges" because Officer Yount did not do anything criminal.

Yount will remain on administrative duty until the Fayetteville Police Department completes its internal investigation.
