The victim will turn 16 this month. She testified Wednesday that she moved to Kansas with Smith earlier this year. She said police picked her up on April 27.
Smith has prior conviction in NC and Fla. He has been convicted on felony sexual battery and was on probation in NC for having sex with the same girl while in NC.
He also served jail time in Palm Springs, Fla. for failing to register as a sex offender there.
