Parents charged in 5-month-old's death

CUMBERLAND COUNTY Investigators say Gabriel Moore died on December 21, 2009 from respiratory complications.

Deputies say 24-year-old Cortney Moore and 35-year-old Aubrey Moore are both charged with first degree murder in the death of their son.

Deputies have accused the parents of intentionally withholding oxygen and breathing equipment prescribed by the child's physician.

Family friends say the 5-month-old was born with under-developed lungs and had to fight for every breath.

"SIDS, that what they was saying and everything," family friend Christiana Pearsall said. "They let her hold the funeral, gave her … and they gave her other child back. So for this to happen it's just crazy."

Despite authorities saying the parents failed to provide medical care, friends of the couple say that's not true.

"I've never seen them do that you know there have been a couple of times where I have given it to them, you know, other than that I don't know where everybody getting this from," Moore's friend Booker Owens said.

"I don't think she could have ever killed her child," Pearsall said. "Not as much as she walked to see that baby in the hospital, through rain sleet and snow, that's not who she is."

However, sheriff's investigators say the charges speak for themselves.

The couple faces first degree murder and child abuse charges. Investigators filed charges after getting autopsy results back from the state medical examiner.

At their first court appearance Wednesday afternoon, a judge told the Moore's they could face life in prison or a death sentence for their son's murder.

The couple was ordered to be held without bond. The judge also set a probable cause hearing for later this month.
