Police say second driver in Womble crash was drunk

WINSTON-SALEM

Fifty-four year-old David Allen Carmichael of Winston-Salem died in the crash on Reynolds Park Road around 11 p.m. December 2.

The accident left Womble hospitalized in critical condition for several days.

Ironically, Carmichael was the son of a man who ran against Womble for his legislative seat in the 1990s.

The preliminary report said Womble crossed the centerline before the accident and was not wearing a seat belt.

The blood-alcohol results from both drivers released Wednesday showed Womble had no alcohol in his system. Carmichael's blood-alcohol level was 0.29. You are considered legally drunk in North Carolina at 0.08.

Womble - a Democrat - is in his ninth term serving Forsyth County. He was the main sponsor of the 2009 Racial Justice Act. The law created a new method for death row prisoners to contest their sentences.
