However, Scott Lassiter's attorney immediately appealed the conviction.
The attorney claims that Lassiter has gastroesophageal reflux disease (GERD) and people with that condition can have a higher-than-normal blood alcohol content. They want an expert witness to testify to that in a jury trial.
The 24-year-old was pulled over by a state trooper last February. He was arrested after refusing to take a blood alcohol test.
