Seven-year-old Daniel Brito, of Mohawk Trail, was rushed to WakeMed where he was initially listed in critical condition. He died on Friday.
NC Highway Patrol said Brito was riding his bike east in the westbound lane on Powhattan Road near Glen Laurel Road in Clayton when he traveled into the path of a 2004 GMC pick-up truck which was heading west.
A preliminary investigation determined that the boy attempted to make a turn when he was hit.
The NC Highway Patrol also noted that alcohol and speed were not a factor in the accident.
The driver of the pickup, 38-year-old Lester Mir, of Salerno Drive in Clayton, will not be charged.
