Man who shot intruder will not be charged

The man who shot an intruder in his home in Raleigh over the weekend will not face charges.

The shooting happened at the Wolf Creek apartment complex shortly after 1:45 a.m. Saturday

Police said 23-year-old Vincent Reed Bellamy was in his apartment when he was confronted by an armed intruder. Bellamy, who also was armed, shot and killed the intruder.

Police identified the intruder as 35-year-old Trevor Anders Herne.

Wake County Prosecutor Colleen Janssen said residents have a right to protect their homes against intruders.

"Those laws were put into place to protect homeowners or residents of homes when they protect themselves against intruders," said Janssen, "and that's exactly what I see as having happened here."

Janssen says she hates that someone died. However, she hopes this will send a message to burglars and other criminals that if you go into someone's home uninvited you could be shot.
