A Cary man is charged with animal cruelty after allegedly leaving a dog out on an uncovered terrace for several hours in the hot sun.

According to an arrest warrant, the 16-month old Boston Terrier named "Maverick" was left out with no water and was taken to a veterinarian for treatment with a temperature over 105.

The incident happened Saturday. The dog was still at the vet on Monday morning.

Thomas Hugh Byrd, 54, of Ballena Circle was charged with misdemeanor cruelty to animals.

The dog has now been placed in protective custody at the Wake County animal shelter while the case moves through the court system.
