Virginia school board appeals transgender restroom ruling

RICHMOND, Va. -- A Virginia school board has asked the full 4th U.S. Circuit Court of Appeals to review a panel's ruling that a transgender teen must be allowed to use the boys' restroom at school.

The Gloucester County School Board says in Tuesday's appeal that the decision imperils the privacy rights of all students.

A federal judge had rejected a sex discrimination claim by Gloucester High School student Gavin Grimm, who was born female but identifies as male. After complaints, school officials adopted a policy requiring students to use restrooms corresponding with their biological gender or single-stall, unisex restrooms available to everyone.

In last month's 2-1 ruling, the appeals court said schools are bound by Department of Education guidelines stating students must be allowed to use restrooms corresponding to their gender identity.
