Michael Peterson could get new trial

DURHAM Wednesday, Durham Superior Court Judge Orlando Hudson decided he will hold a hearing to determine whether prosecutors withheld critical evidence during the trial.

Peterson was convicted of killing his wife Kathleen in 2003.

The murder weapon was believed to be a fireplace blow poke, but the evidence now called into question is a tire iron.

It was found days after the murder in a neighbor's yard, but it was never admitted into evidence and never brought up at trial.

The hearing on this evidence is expected in January or February. No exact date has been set.
