No new trial for Peterson

RALEIGH He a jury said the well-known writer killed his wife Kathleen. She was found murdered in the couple's Durham home in 2001 at the bottom of a staircase.

Peterson was convicted in 2003, but his lawyers said prosecutors withheld evidence about a tire iron found in a neighbor's yard. They say the tire iron bolstered their claim that an intruder killed Peterson's wife - not him.

During the first trial, Peterson's lawyers argued Kathleen fell down the stairs in a drug and alcohol induced stupor.

Peterson is serving a life sentence.
