The judge made the decision Tuesday and will hear arguments for dismissing Edwards's case later this month.
Edwards is accused of using campaign money to cover up an affair with Rielle Hunter, who also is the mother of his youngest child.
The judge will hear five motions to dismiss the case, including prosecutorial misconduct involving then US attorney George Holding and conspiracy charges.
The hearing is scheduled for October 26 in Greensboro.
