Driver charged in death of child

FRANKLIN COUNTY, N.C.

It happened just after 8 p.m. Saturday on NC-561 and Reynolds Road in Franklin County.

Investigators said the 21-year-old driver of the ATV ran a stop sign and was hit by a pickup travelling west on NC-561.

Brennan Lee Perry, of Warrenton, died of his injuries. The ATV driver - Trevor Tyler - and an unnamed 4-year-old who was also riding on the 4-wheeler, were taken to the hospital for treatment of non-life-threatening injuries.

Tyler was charged with misdemeanor death by vehicle. According to family members who spoke with ABC11, he said the brakes on the ATV failed and he couldn't stop in time.

"I know he tried to avoid it. His brakes just happened to go out on him at the wrong time and the wrong place," said family friend Linda Woleben.

The driver of the pickup wasn't hurt.
