Judge Paul Ridgeway ruled Monday that the suit filed by North Carolina Citizens for Progress be dismissed.

The group had sought to have a court declare that the ads that claimed McCrory lobbied to get tax breaks for tree.com while serving as mayor of Charlotte and was later paid over $140,000 to sit on the company's board were factually correct.

McCrory has said the accusations are false and threatened to sue to have them taken off the air. But, he never filed a lawsuit.
