More than 3,000 surgical patients were exposed to instruments washed in used elevator hydraulic fluid.
Many of those patients said they suffered health problems after the exposure.
Duke settled with 127 patients for the sum of $26 million. They wanted the insurance company to pay out $6 million. However, a judge says the $1 million already paid is enough.
