Still unclear whether charges will be filed in knife-wielding man's death by police

DURHAM

On July 27, the 33 year old was shot and killed by Durham police when he refused to drop a knife in his hand in the 800 block of Park Avenue.

An attorney for Ocampo's family says he has three eyewitnesses who claim Ocampo never posed an imminent threat and that the shooting was not justified.

The district attorney's office says it's still waiting on Ocampo's autopsy to be completed.

The shooting is being investigated by the N.C. State Bureau of Investigation and the Durham Police Department's Professional Standards Division and Criminal Investigations Division, which is standard procedure in any officer-involved shooting.
