The Durham County District Attorney's Office says it's still waiting on the agency's final report on new information it received in late January.
"We expect to get it any day now," District Attorney Leon Stanback told ABC11.
A spokesperson for the N.C. Attorney General's Office confirms the SBI is still reviewing the case. Neither office would comment on specific details of their second investigation.
Jesus Huerta, 17, was found dead in the back of a police car last November. The Durham teenager died from a self-inflicted gunshot wound while handcuffed, according to the Durham Police Department and the SBI's initial investigations.
Durham investigators admitted the arresting officer failed to properly search the teen, who was taken into custody for an outstanding trespass warrant. Officers were looking for Huerta after his family reported him missing and possibly suicidal.
Durham Police said there was no evidence the weapon was inside the officer's squad car prior to Huerta's arrest.
An attorney for the teen's family has criticized the police department's independent investigation, pointing to another teenager arrested with Huerta. According to the Huerta family and their attorney, Huerta's friend told police they were unarmed.
The Durham County District Attorney announced in January that his office would not seek criminal charges against the arresting officer.
