FUQUAY-VARINA, N.C. (WTVD) -- The Fuquay-Varina Police Department said Wednesday that no charges will be filed in a May incident in which a boy suffered facial injuries.

Agustin Luna told ABC11 that he wanted charges filed after his son Agustin and his little brother drew on each other with magic markers. Luna said he tried to wash it off, but couldn't. He claimed a teacher at Little Angels Preparatory School used soap and a brush the next day and the boy's face was scrubbed raw.

But in a news release, police said: "Through our extensive investigation, Fuquay-Varina Police obtained information that the child in this case had sustained additional injuries unrelated to the Little Angels Preparatory School and were unrelated to any criminal, physical abuse occurring at the school/day care or elsewhere."

After consulting with the district attorney's office, no charges will be filed.

Police did not explain how the child was injured.
