Jennifer Stehle and her husband, Justin, filed the lawsuit on Wednesday, claiming that Quinten Kight was driving drunk at the time of the Aug. 2 crash.
It also alleges that eight adults and two children were on the boat that ran over swimmers and that after the crash, Kight was focused on concealing his impairment by allegedly dumping dozens of containers of alcohol into the water.

The 41-year-old Stehle, who is a Wake County school social worker, lost her left leg above the knee because of the crash and sustained "severe and disabling injuries" to her right leg.
The suit also comes just one day after ABC11 learned of another lawsuit filed by the family of Brooklyn Carroll, a 10-year-old Cary girl who died in the same incident.
Stehle's lawsuit, filed by the Law Offices of James Scott Farrin, seeks punitive and other damages.
