TARBORO, North Carolina (WTVD) -- A man is in custody Monday after law officers said he engaged in a sexual act with a minor.

Tarboro Police and the Edgecombe County Sheriff's Office responded to a home on Kathryn Lane in reference to a teenaged runaway.
They found the 13-year-old inside with 30-year-old German Cruz Capetillo.
Capetillo was charged with statutory rape and placed in the Edgecombe County Detention Center under no bond.

The US Department of Homeland Security was contacted and the process for an Immigrations and Customs Enforcement Detainer was started.
