According to The News & Observer, Faust, 41, is charged with murder and attempted murder in the Feb. 12 death of her 3-year-old son and the attempted murder of her 2-year-old son at their home on Chartwell Court in Durham.
Faust's defense attorney, Nicole Galinsky, filed a motion Tuesday indicating Faust will argue she is not guilty because of insanity and diminished capacity.
Faust has been hospitalized at Central Regional Hospital in Butner since April in an effort to restore her capacity to stand trial, according to court documents.
She attempted suicide while being held in the Durham County Jail after the crimes allegedly occurred in February.
On May 21, doctors at the hospital deemed Faust competent to stand trial, according to Durham County Assistant District Attorney Mary Jude Darrow.
However, Darrow later filed a motion seeking a psychological evaluation of Faust. The motion was based on a July 29 report from Dr. Adrianne Saxton, a Charlotte-based forensic psychiatrist.
Saxton found Faust was "laboring under a defect of reason from disease of the mind" and could not determine right from wrong at the time of the incident.
A judge has not yet ruled on Darrow's motion. Faust remains hospitalized at Central Regional Hospital. Her next court date is tentatively scheduled for October.
