Officers responded around 10:58 a.m. to the 100 block of Summit Avenue for a reported shooting. When they arrived, they found a man suffering from a gunshot wound to his upper body.
He was taken to a hospital, where he later died. Police identified him as 39-year-old Emmanuel Graham.
Investigators said another man at the scene was seriously hurt in an assault, but his injuries were not life-threatening.
Authorities told ABC11 that Graham and another man who knew each other and were living in an encampment got into an argument that escalated. Investigators say Graham struck the other man with an ax and continued the assault as the man tried to run toward Summit Avenue.
That's when, police say, a nearby witness stepped in.
Investigators said the witness saw the attack and believed the man running away was in immediate danger. The person retrieved a handgun and shot Graham once.
Police said the witness remained at the scene and cooperated with officers.
After reviewing witness statements, video and physical evidence, the Wake County District Attorney's Office determined no criminal charges will be filed.
No arrests have been made, and the investigation is ongoing.
