Lawyers for accused Raleigh mass shooter, Austin Thompson, ask for trial to be delayed

RALEIGH, N.C. (WTVD) -- Attorneys for accused Raleigh mass shooter Austin Thompson are asking for his trial be moved to next year.

They say Thompson was shot in the head during his standoff with police three years ago in Raleigh's Hedingham neighborhood.

Attorneys argued that his injuries sustained from being shot during the standoff mean he should be re-evaluated before decisions are made on how to proceed to trial.

According to the court filing from Thompson's attorney, "as a result of Austin's severe brain injury, compounded by his adolescence and the passage of three years, Austin is functionally an entirely different person than he was at the time of this event"

It goes on to say that "current evaluations do not fully identify Austin's personality, state of mind, capacity to plan, or mental health at the time of this incident. Because of this, there are much higher demands on the defense team to obtain the records and interview collateral sources to develop this information."



Thompson was 15 years old when he was accused of killing five people in the Raleigh neighborhood in 2022.

They also say they want more time to investigate the facts of the case as well as Austin's life story.

This most recent court filing is asking for the trial date to be pushed back to February of 2026. The case was scheduled to be heard in September.

Thompson is charged with 5 counts of first-degree murder, 2 counts of attempted first-degree murder and two counts of assault with a deadly weapon with intent to kill on a law enforcement officer.

A judge previously ruled that Thompson would be tried as an adult but would not be eligible for the death penalty.
