RALEIGH (WTVD) -- The state's highest court has set a date to hear the latest appeal in the Jason Young case.
The justices will hear arguments on May 19.
Last year, the state court of appeals overturned Young's March 2012 murder conviction. However, the state is appealing that decision.
The North Carolina Court of Appeals said jurors should not have heard Young did not respond to a civil wrongful death lawsuit that found him responsible for his wife's murder.
A pregnant Michelle Young was found beaten to death in the couple's home back in 2006. The couple's toddler-aged daughter was at home at the time of the killing, but was not injured.
At Jason Young's first trial in 2011, a jury couldn't come to a verdict, deadlocking 8-to-4 for acquittal. Eight months later, he was tried again and convicted, after prosecutors introduced evidence that wasn't used in the first trial.
Jason Young is serving a life sentence at the Alexander Correctional Institution in Alexander County.
