WakeMed Campus police have charged a certified nurse assistant who worked at the Raleigh hospital with having sex with a patient.

RALEIGH (WTVD) -- WakeMed Campus Police have charged a certified nurse assistant who worked at the hospital with having sex with a patient.

Bryan Scott Avery, 34, of Fuquay-Varina was booked into the Wake County jail on a charge of a sex offense at an institution. Bond was set at $30,000.

Court documents show the incident happened between January 13 and 15. WakeMed said, while it allegedly happened in January, it was not reported until last week.

An arrest warrant says the victim was "in the custody of WakeMed Health and Hospitals." A prosecutor said the adult female was a patient there.

WakeMed said Avery - who worked as a nurse tech - was fired after the incident which involved an adult patient.

"This employee's behavior is not representative of WakeMed and does not reflect the values we work hard to instill in our staff," the facility said in a statement.

Investigators have not said if the alleged incident was consensual but under state law it doesn't matter because employees of institutions are forbidden from having sex with patients under any circumstances.
