Apex council member found guilty of drunken driving

An Apex town council member was found guilty Wednesday on drunken driving charges.

However, Scott Lassiter's attorney immediately appealed the conviction.

The attorney claims that Lassiter has gastroesophageal reflux disease (GERD) and people with that condition can have a higher-than-normal blood alcohol content. They want an expert witness to testify to that in a jury trial.

The 24-year-old was pulled over by a state trooper last February. He was arrested after refusing to take a blood alcohol test.
