Che Skaggs died Saturday in front of his Orange County home after being hit while he was skateboarding. His 14-year-old brother was injuried.
Police say the man responsible, Scott Belling, was drunk when he hit Skaggs. Police records show Belling's blood alcohol level was more than twice the legal limit.
Belling has been charged with driving while impaired and death by motor vehicle.
