An autopsy report from the North Carolina Office of the Chief Medical Examiner shows a man who killed a 22-month-old baby before turning a gun on himself had alcohol in his system.

The report on the body of 25-year-old Tyrone Xavier Hester shows a blood-alcohol level of .15. In North Carolina, drivers are considered legally drunk at .08.

Durham police say the murder-suicide happened May 7 at an apartment complex on Chalk Level Road.

Hester was pronounced dead at the scene. Hester's daughter Aaishia was critically injured. The baby was taken to Duke University Hospital, where she was pronounced dead.

Friends say Hester was despondent because he and the child's mother - his girlfriend of four and a half years - had recently broken up.
