Angela Diljak and Rodney Hodge are accused of leaving their three children locked in the family minivan while they filled out divorce paperwork inside the Wake County Courthouse.
The couple was arrested and charged Friday morning.
Someone saw the children, ages 2, 4, and 6, in the van and called police.
Officers unlocked the van and placed the children in an air-conditioned squad car. Police say the children were "very warm" but okay.
They were released into the custody of relatives.
