County commissioners were notified of the investigation Friday.
Family members told ABC11 Eyewitness News DSS investigated Shaniya's mother, Antoinette Davis, in the past. However, Davis was allowed to keep Shaniya and her 7-year-old son.
Davis is charged with human trafficking and child abuse by prostitution.
Mario McNeill, an acquaintance of Davis', is charged with raping and killing 5-year-old Shaniya.
