Bicyclist charged with DWI

SMITHFIELD, N.C.

Smithfield police stopped 45-year-old James Michael Tobias after he allegedly ran a stop sign on South Fifth Street near Holt Street and was nearly hit by a car.

Officers said Tobias registered .16 on a breathalyzer test. You're considered impaired in North Carolina at .08. Tobias was charged with DWI.

He also faces marijuana possession charges.

Bond was set at $2,000.
