Duke appeals slander ruling

DURHAM They argued against a ruling that allows former men's lacrosse coach Mike Pressler to pursue a slander lawsuit against the school and its former spokesman.

Duke wants to convince the Court of Appeals to overturn the decision by Superior Court Judge Howard Manning that nullified a settlement last year between Pressler and the university.

Pressler settled with the school after he was fired over a woman's false accusations that three players raped her. But, the coach's lawyers say Duke broke that settlement because former school spokesman John Burness made disparaging comments about Pressler to the media.

Manning agreed and allowed Pressler's slander suit to go forward, but Duke lawyers claim federal law mandates arbitration.
