Peak files for bankruptcy

RALEIGH That's according to the company's Charlotte based bankruptcy attorney.

Jim Henderson told Eyewitness News that the restructuring does not affect over 31 locations in other areas.

Henderson said the intention is to keep the locations open while seeking bankruptcy protection. If clubs are closed, customers will be offered memberships at nearby locations.

In January, Peak Fitness settled a lawsuit filed by the North Carolina Attorney General's Office over its contracts and billing practices. The AG's Office said it had received hundreds of complaints over the past five years.

Among other changes, Peak agreed to designate a point of contact person at each club to handle complaints and post contact information at clubs and on its website.
