Hayes is charged with killing Laura Ackerson.
Ackerson is Hayes' ex-girlfriend and the mother of his two young boys.
An attorney from the Capital Defender's Office will now be appointed to his case. Hayes' wife, Amanda, also is charged in connection with the crime.
Prosecutors could decide as early as December 15 whether to pursue the death penalty against each of the defendants.
