Duke players ask approval for lawsuit

The former DA charged the three lacrosse players in 2006 of sexually assaulting an escort service dancer. The charges against the players were later dropped by the state attorney general.

Nifong stepped down from his position and was later disbarred. He recently filed for bankruptcy in January.

The three players, David Evans, Collin Finnerty and Reade Seligmann are asking the court to remove Nifong's bankruptcy protection, allowing the players to pursue damages in their civil lawsuit against.

When Nifong filed for bankruptcy, he listed the three players as unsecured creditors owed $30 million apiece.
