Judge to consider Cline affidavit

Last week, Durham lawyer Kerry Sutton filed an 11-page affidavit asking a judge to determine if Cline should be removed from her office on the grounds of habitual intemperance and conduct prejudicial to the administration of justice. Sutton said ongoing attacks Cline has made against Judge Hudson are grounds for her removal.

On Tuesday, Hudson asked Franklin County Judge Robert Hobgood to consider that affidavit.

Hobgood told ABC11 Wednesday morning that he will be in Durham Thursday to review the removal petition. If he decides there's probable cause, a hearing will be held.

Cline has been involved in a feud with Hudson, who she has accused of bias against her in cases. Cline has even called Hudson dishonest and corrupt. However, critics have said Cline's actions are undermining the integrity of the court.

Cline has denied any wrongdoing in the past.
