Marvin Williams says his IQ is under 70, which means he's mentally retarded. State law says such defendants cannot be executed. Williams has scored above and below 70 on various IQ tests.
A judge will have the final say.
Sixteen other inmates have been taken off death row. All remain in prison.
Williams is convicted of killing Theron Prince in 1989 during a robbery in Goldsboro.
