Garner police said 39-year-old Omar Kareem Sellers was selling ice cream around 9 p.m. near the Avery Square Apartments when he started talking to a group of kids, including a 14-year-old girl.
Witnesses told police that the girl voluntarily got into Seller's white conversion van ice cream truck with colorful polka dots on it and left the area.
"By the time I got outside, they were gone," said Joann Octetree, who was looking after the teen. "The first thing I thought about was her mother and like, 'Is she alright, where is she at?'"
The victim told ABC11 her and Sellers drove through a few neighborhoods, then ended up at a self-service car wash in Johnston County. She said Sellers pulled into a bay and raped her.
Around 10:20 p.m., Garner police issued an Amber Alert for the 14 year old, but canceled it a short time later after an officer spotted the truck on Creech Road near Creech Road Elementary School.
Sellers was charged with one count of indecent liberties with a child, two counts of statutory rape/sex offense and one count of first-degree kidnapping.
"There's no indication of any force or any violence in this, but still these charges can be based on age, solely on that, that's why they're statutory offenses and that conduct would be inappropriate with a 14 year old," said Lt. Wayne Moore with the Garner Police Department. "I've got no indication that there's any other victims, but I'm sure that when this goes on the news, if any body has information or if they have questions, please come forward and let us know."
Garner police said they have contacted other police departments to see if Sellers sold ice cream anywhere else.
Sellers, who has a lengthy criminal history including concealed weapons charges, is currently being held at the Wake County Jail on a $1 million bond.
"He should serve the maximum sentence for his charges and never ever be able to be out on the streets again because It could have went any way, you know. I may not have ever seen my daughter again. It could have been anyone else's child," the victim's mother said.
