The shooting happened around 3 p.m. October 16.
The 67-year-old victim was shot in the arm and suffered a graze wound to his abdomen.
Officers with the Durham Police Department Violent Incident Response Team (VIRT) arrested Nelson Pinto at his home on Faucette Avenue Thursday.
He is charged with assault with a deadly weapon inflicting serious injury, assault with a deadly weapon, and discharging a firearm within the city limits.
Police said they don't believe the man who was shot was the intended target.
