Investigators have charged 21-year-old Lyndsey Smith, of Durham, with accessory after the fact in the case and harboring a fugitive. Smith's bond was set at $1.5 million.
Earlier Wednesday, Smith's reported boyfriend, Mikel Edward Brady II, was led into a Durham County courtroom just 24 hours after his arrest in connection with the shooting.
Brady, of White Pines Drive in Durham, is charged with assault with a deadly weapon with intent to kill.
He is accused of shooting Trooper Michael Potts Monday evening in the westbound lanes of U.S. Highway 70 at Cheek Road near Interstate 85.
Authorities said Potts pulled over a newer model black Nissan with 30-day temporary license tags because the driver wasn't wearing a seatbelt. That's when the driver, believed to be Brady, allegedly opened fire.
"I was driving by as the officer went to the window, the officer took a glance at the road and started to head back and then a few shots fired, the officer hit the ground," a caller told a 911 operator Monday.
Potts, 42, was later taken to Duke University Hospital where he was last listed in fair condition after two surgeries. He was shot four times and suffered wounds to each hand, his right shoulder, and the right side of his face.
The Nissan was found behind a restaurant in the 2000 block of North Roxboro Street late Monday. Sources told ABC11 that private surveillance video captured a visibly pregnant Smith picking up Brady in the parking lot shortly after the shooting.
After a multi county manhunt, Brady was arrested Tuesday morning at an apartment complex in Raleigh.
Authorities said Brady had dyed his blonde hair burgundy during the time police were searching for him.
On Wednesday, Judge George Marsh granted the state's request to set Brady's bond at over $8 million.
He is also wanted on an absconder warrant from Vermont.
"I believe he's on furlough on breaking and entering charges," Assistant District Attorney Brian Raymond Jones told the judge Wednesday. "He's also on federal probation, your Honor, I believe for charges of theft of explosives. He's convicted in 2011 of grand larceny."
Judge Marsh has set Brady's bond for that fugitive charge at $2.5 million, and said Brady won't be extradited until the court deals with his charges related to Monday's shooting.
