RALEIGH (WTVD) -- New charges were filed on Tuesday against a man accused in a 2009 murder.
James Courtney, 49, was tried for the murder of James Deberry, but the jury deadlocked and he wasn't convicted.
Deberry was found shot on Shadetree Lane on Halloween night in 2009. He was taken to WakeMed where he died.

Investigative work has continued since the trial, and Courtney was re-arrested and charged with murder.
Police said the case remains under investigation.
