Until his bankruptcy case is complete, the embattled former prosecutor will likely get to avoid the pending lawsuits against him stemming from the /*Duke Lacrosse*/ case.
Initially, the bankruptcy court administrator, Michael D. West, believed /*Nifong*/ earned too much money to qualify for bankruptcy protection. But, in recent weeks, Nifong has submitted additional financial records, encouraging the court to change its mind.
Tuesday West said in a written statement that he "does not consider a motion for dismissal in this /*Chapter 7*/ to be appropriate."
Nifong is named in two lawsuits related to his handling of the Duke Lacrosse case. A third lawsuit recently filed by dozens of former lacrosse players did not name Nifong because of his bankruptcy status.
