Most of the people who live in the neighborhood near Hewberry Lane say they knew nothing about the death until they saw police and heard about it on the news.
Police were called to building 3320 at Walnut Ridge Apartments Wednesday evening.
Someone had called 911 about a 2-year-old boy in distress. The toddler was rushed to the hospital where he was pronounced dead.
Initially, police charged 24-year-old DonJuan Smith with involuntary manslaughter in the child's death.
Investigators say that charge was based on information available at that time. But now the charges against Smith have been upgraded to murder.
The exact events that took place at the apartment are not known at this time, but one resident of the complex tells Eyewitness News Smith is the boyfriend of the toddler's mother and was taking care of the child at the time.
