The driver of the other vehicle, Stephen Thorpe Diller, 56, of Garner, was treated on scene for minor injuries and released.
The accident happened on Eastbound Glenwood Avenue between Toscana Drive and Lake Anne Drive.
Tests for drugs and/or alcohol for Davis are still pending.
