He told a judge, Morris, and his lawyer at a Rule 24 hearing in Oxford.
A Rule 24 hearing is one in which the prosecution is required to say in court whether or not the state is going to seek the death penalty in a first-degree murder case.
Morris, 35, of Creedmoor, is charged with first-degree murder in the death of his wife Kelly Currin Morris. Investigator say Morris also set the couple's house - located southeast of Stem - on fire.
Kelly was 28 when she vanished Sept. 3, 2008. Her remains were found in a wooded area in November and Morris was arrested.
