Judge won't delay NewHope church noise lawsuit

DURHAM, N.C.

The case against NewHope Church is set to go to trial in June.

In a lawsuit filed in January, neighbors of the church located on Fayetteville Road accuse it of holding performances and practice sessions at its facility that are "akin to rock concerts." Five families living in The Hills at Southpoint subdivision have joined the suit.

A criminal noise citation filed by Durham Police was tossed out last month when a key witness did not show up for a court hearing.

Sound tests at the church and nearby homes are set for Sunday.
