Cooper is accused in the 2008 death of his wife Nancy. Her body was found dumped in an undeveloped Cary subdivision.
In a motion filed yesterday, Cooper's lawyers claimed information they need to prepare for trial has not been handed over by the prosecution.
Cooper's trial is slated to begin February 28, with testimony to begin about a week later.
